Oops, Wrong House: Greensboro [NC] police say an 80-year-old man is
not facing charges after he shot and killed a break-in suspect early
Wednesday morning. Charles Haithcock called 911 immediately following
the shooting of 19-year-old Michael L. Medley who he says broke into
his home. "A man broke in on me and pulled a gun. I shot him and he's
laying out in the yard." …When officers arrived, they found Medley,
Jr. dead from a gunshot wound. "The guy ran into the back room, locked
his door and shot through the bedroom door and killed him," said
Haithcock's neighbor, who did not want to be identified… (All's well
that ends well but shooting through a door is a tricky proposition.

Oops, Wrong Pawn Shop: One of two men who tried to rob the Broadway
Joe's Pawn and Jewelry Shop was in critical condition Thursday night
after being shot by a store employee. The other man was still at
large. About 3:25 p.m., two men entered the business, 1435 Broadway at
Parmele Street, and attempted to rob the store. A store employee
retrieved a handgun that was stored inside the business and fired at
the two. One of them was struck by the gunfire inside the store while
the second man fled the scene on foot, Deputy Chief Theo Glover said…

Oops, Wrong House, Louisiana Version: A would-be robber is recovering
from gunshot wounds as Caddo sheriff's deputies work to determine who,
if anyone, helped him during a home invasion early Thursday. Dion
Lewis, 30, was shot by the owner of a home in the 1100 block of Oak
Grove Lane in south Caddo when Lewis broke the dwelling about 3 a.m.,
Caddo Sheriff Steve Prator said. The homeowner, one of three people
asleep inside, "was awakened by someone kicking in the front door of
his house," the sheriff said. "He armed himself with a handgun. And
when the suspect appeared at his bedroom door, the homeowner opened
fire several times." Deputies say Lewis fled and, about 30 minutes
later, showed up at Willis-Knighton Pierremont with wounds to both

Further Details on Florida Shooting: Tired from a long day at work,
brothers Anthony and Peter Julien arrived home Tuesday night to find a
bedroom light on and two bicycles in front of their Pine Hills home.
Anthony Julien went inside through the garage, a 9mm gun in his hand.
One intruder was in Julien's bedroom to the right. Another man was
pointing a gun at him from the dining room on the left. Julien dropped
to one knee, knowing it was the stranger or him. "When I saw he had a
gun in his hand, I bent down and, 'pow,' I shot him right here,"
Julien said. Both brothers opened fire. One intruder was killed, and a
second was wounded. The Orange-Osceola State Attorney's Office will
decide whether charges should be filed against Anthony Julien, 50, or
his brother, Peter, 57. Under the state's Castle Doctrine, however,
residents can legally use deadly force to protect themselves against
intruders… (All's well that ends well but many of us who were
influenced by Jim Cirillo counsel against using kneeling or prone

Oops, One Too Many: A would-be robber is dead after one of his alleged
victims fights back. It happened on North Street in Philadelphia's
West Oak Lane section early Sunday morning. Investigators say it
apparently never crossed the thief's mind that his victim just might
be armed. Police say it was the man's third robbery of the night. He
forced the victim up against a vehicle along the street and demanded
money. That's when shots rang out - but not from the alleged robber…
Aaron Wisher was listening to the radio in his West Oak Lane home just
after midnight when he heard a man on his cell phone quickly followed
by seven or eight gunshots… He called 9-1-1 and police responded to
investigate. As it turns out, the man who was being robbed had a
license to carry a firearm, and shot the alleged robber. Police say at
this time no charges are expected to be filed. (Journalism schools
need to start teaching the differences between theft, robbery and
burglary. In most states a crime is elevated from theft to robbery
when there is the use or threat of force. Burglary typically involves
entry of a structure or fenced land with the intent to commit theft.
Depending on the value of what is stolen, theft may only be a
misdemeanor but robbery and burglary are generally high-grade
felonies.)

Oops, Wrong House: What started early Thursday morning as a home
invasion has ended in the death of the alleged intruder. Just after 5
a.m., Bexar County [TX] Sheriff's deputies responded to the scene in
the 11400 block of South Foster Road. Deputies say 24-year-old Cardell
Deon Joseph broke through the front door of a home there, and that's
when the homeowner shot him once in the intruder's rib cage area. They
say the Joseph then ran from the house and drove away, but he then
crashed his vehicle a few blocks away. According to reports, the
suspect was still talking after the crash, and asked the homeowners
for help. But, Joseph later died at the scene. It's unclear whether
the crash or the gunshot wound was the major factor in his death.
Bexar County records show that Joseph was in trouble before. He was
arresed for evading arrest and possession of marijuana. The Bexar
County district attorney's office will review the case.

the Dayton cases face any criminal charges. Ohio's Castle Doctrine
Law, which went into effect last year, allows residents to defend
their homes and occupied vehicles from invaders by any means

the owner of a Warren Avenue home after they broke into the residence
are in jail facing felony burglary and robbery charges. Julio Urena,
17, and Juan Martinez, 25, pleaded not guilty to the charges Monday
afternoon in Village Court. Haverstraw [NY] Village Justice Ronald
DeCaprio set bail at $50,000 for each suspect. Urena was shot in the
buttock and Martinez was shot in the arm after a home on Warren Avenue
was broken into shortly after 9 p.m. Sunday… The homeowner shot both
suspects with a rifle, he said. No charges were brought against the
homeowner. Permits are not required to own a rifle… (This shooting was

are calling a confrontation with the owner of a neighborhood market at
Raymond and Campbell streets. Akron Police Lt. Rick Edwards said the
store owner, Ali Ahmed, 59, had closed for the night and was walking
to his vehicle in the rear parking lot at about 7:30 when the suspect
approached. There was an exchange of gunfire - witnesses reported
seven or eight shots - and both men were hit, Edwards said. Ahmed was
taken by ambulance to Akron General Medical Center with wounds that
were not life threatening, Edwards said… According to police radio
traffic moments after the shooting, one man was shot in the head and
the other in the hand… Ocie Priester, a 60-year-old who does interior
remodeling, said Ahmed was aware of the dangers of owning such a store
and took measures to protect himself. Ahmed had a .44-caliber handgun,
he said, and showed it to him once… (Note the shot to the hand,
presumably Ahmed's. I have long cautioned that guns, gun hands and
gun-hand arms and shoulders are often hit in gunfights. This is why
it's important to learn to shoot with either hand and to have a
firearm available to either hand. I recognize that it is possible that

Oops, Wrong House: A New Jersey man who was shot and killed during a home invasion in Halifax Friday morning was likely seeking revenge for a two decade-old domestic dispute, according to Halifax County [NC] Sheriff Jeff Frazier. The investigation is ongoing into details of the 1988 dispute between Marcel Alston, of Halifax, and Carlton L. Burg… Investigators said that a knock woke up Alston around 7 a.m. at his house at 5524 U.S. Highway 301, where he lives alone. When Alston opened the door, Burgess, who had a gun, began assaulting Alston. Alston got away and was climbing up the stairs when Burgess fired, striking his victim in the buttocks, investigators said. Alston managed to get to his bedroom and got out a gun he kept there. Burgess followed Alston into the bedroom, and Alston fatally shot him in the upper torso, according to investigators… (Note that the shot to the buttocks, which is part of the pelvic area, apparently and predictably limited Alston's mobility but did not fully incapacitate him. Unless the round strikes one of the large blood vessels in the lateral pelvis, a shot to the pelvis is best viewed as one that could well require a follow-up, after the mobility of the "target" has been impaired.)

Oops, Wrong Car Wash: A man suffered life-threatening wounds when he attempted to rob another man at a midtown car wash and was shot by the victim, Tucson police said. The incident occurred at a self-service car wash on East 22nd Street near South Beverly Avenue just before 4:30 p.m. Tuesday. Police said a 50-year-old man was at the car wash washing his vehicle when he was approached by an 18-year-old man. The younger man pulled out a gun and attempted to rob the older man, police said. The older man pulled out his own gun and shot the 18 year old. The younger man ran away and got into a car that was being driven by another person. A short time later, the 18-year-old man showed up at a hospital with life-threatening wounds, police said. The 50-year-old man was not injured. He's being questioned by police as is the driver of the car who took the wounded man to the hospital.

Homeowner Rescues Animal Control Officer: Plainfield [CT] Animal Control Officer Terry Foss was attacked by a "pit bull-type dog" late Tuesday night, according to Plainfield Police. Foss was responding to a complaint at 270 Green Hollow Road, where, according to residents, the dog was preventing them from exiting their home. On her arrival, the dog jumped at Foss, knocking her to the ground. Resident Ron Roberts fired "2 or 3 shots" from a .22 rifle at the dog, which police say yelped and ran away… Police Chief Robert Hoffman said Roberts will not face charges from shooting at the dog. He said the department thanked Roberts for his action. "It sounds like it could have been a lot worse had he not been there," Hoffman said… (Actually, Roberts had to have been there as the dog showed up at his home. It would have made more sense for Chief Hoffman to have expressed gratitude for Roberts having had the foresight to arm himself.)

Oops, Wrong House: A homeowner shot and wounded a burglar who entered
his bedroom while he was on the phone with a 911 operator, deputies
with the Harris County [TX] Sheriff's Office said this morning. Around
2:30 a.m., a homeowner in the 13000 block of Lima near Beechnut in
southwest Houston called 911 to report an intruder. The burglar,
possibly hearing something coming from the bedroom, opened the door
and was shot in the arm, deputies said. The 19-year-old suspect was
taken to a hospital with a non-life-threatening injury and was
expected to be booked into jail once he was treated. A woman in a car,

Oops, Wrong House: A homeowner shot and wounded a burglar who entered
his bedroom while he was on the phone with a 911 operator, deputies
with the Harris County [TX] Sheriff's Office said this morning. Around
2:30 a.m., a homeowner in the 13000 block of Lima near Beechnut in
southwest Houston called 911 to report an intruder. The burglar,
possibly hearing something coming from the bedroom, opened the door
and was shot in the arm, deputies said. The 19-year-old suspect was
taken to a hospital with a non-life-threatening injury and was
expected to be booked into jail once he was treated. A woman in a car,

Oops, Wrong Truck: Police said one of two men who tried to steal a
pickup truck from a group of people gathered outside a Murray Hill
home was shot several times by a homeowner and his friend.
Jacksonville [FL] Sheriff's Office Lt. Larry Schmitt said when police
arrived at the 3000 block of College Street, they found a man shot
multiple times. According to the police report, Keith Loftin was
outside the home with some friends shortly after 2 a.m. when two men
asked for a ride in Loftin's truck. Loftin said one of the men pulled
a gun on them and forced Loftin into his truck. Loftin told officers
that his friend, Barry Smith, ran into the house and returned with a
gun and Loftin pulled his own gun from inside the truck. Police said
both Loftin and Smith fired at one of the men, striking him multiple
times. The man shot, identified as Jamel Mobley, 21, of St. Marys,
Ga., was taken to Shands-Jacksonville Medical Center and was in stable
condition. Police said the second man took off. Police were still
looking for him, but they have only a vague description…

Oops, Wrong House, California Version: Three suspects arrested in
Sutter County after an attempted home burglary ran into the worst of
luck - a homeowner with experience fighting off intruders. Two women
and a man, all Sacramento residents, broke into an isolated house at
about 2 p.m. Monday in the 3900 block of O'Banion Road west of Yuba
City, according to Sheriff J. Paul Parker. The owner, David Massey,
armed himself with a handgun and discovered one woman in his kitchen
while the other woman and the man fled out the back door, Parker said.
The suspects got into a Ford Explorer parked on the circular driveway
outside and drove it toward Massey, but he fired six shots toward the
vehicle just before it rolled onto its side, the 63-year-old homeowner
recalled Monday night… Massey's last encounter with suspected burglars
also ended in gunfire. On July 2, 2008, deputies arrived at his house
after he reportedly fired his handgun at a suspected burglar fleeing

Oops, Wrong House, Kashmir Version: A teenage girl says she killed a
militant with his own gun after insurgents attacked their home in
Indian-administered Kashmir. Three militants stormed into Rukhsana
Kauser's home in a remote village in Jammu region on Monday and
started beating her parents in front of her. Ms Kauser, 18, and her
brother turned on the gunmen, killing one and injuring two more.
Police praised their courage. One of the militants wanted to marry Ms
Kauser against her will, police said. The militants escaped and are
now being sought by police who are using their blood trails as clues…
Ms Kauser said she grabbed one of the militants by the hair and banged
his head against the wall. When he fell down she hit him with an axe,
before snatching his rifle. "I fired endlessly. The militant commander
got 12 shots on his body." Her brother, Eijaz, 19, grabbed one of the
other militants' guns and also began shooting… "I had never touched a
rifle before this, let alone fired one. But I had seen heroes firing
in films on TV and I tried the same way. Somehow I gathered courage -

Rukhsana Kausar, 21, was with her parents and brother in Jammu and
Kashmir when three gunmen, believed to be Pakistani militants, forced
their way in and demanded food and beds for the night. Their house in
Shahdra Sharief, Rajouri district, is about 20 miles from the
ceasefire line between Indian and Pakistani forces. It is close to
dense forests known as hiding places for fighters from the
Lashkar-e-Taiba group, which carried out the Mumbai terrorist attack
last November. Militants often demand food and lodging in nearby
villages. When they forced their way into Miss Kausar's home, her
father Noor Mohammad refused their demands and was attacked. His
daughter was hiding under a bed when she heard him crying as the
gunmen thrashed him with sticks. According to police, she ran towards
her father's attacker and struck him with an axe. As he collapsed, she
snatched his AK47 and shot him dead. She also shot and wounded another
militant as he made his escape. Police have hailed the woman's
bravery. They said she would be nominated for the president's
gallantry award. She may also receive a £4,000 reward if, as police
believe, the dead terrorist is confirmed as Uzafa Shah, a wanted
Pakistani LeT commander who had been active in the area for the past

Oops, Wrong Coin Collection: A man stealing a coin collection in a
Hilton Head Plantation home at noon Wednesday found himself running
for his life after the homeowner shot at him and chased him out of the
house. The unidentified man, who was armed with a large stick or club,
broke into a house on Teal Lane while the residents were inside,
according to a news release from the Beaufort County [SC] Sheriff's
Office. The intruder entered through the unlocked front door and
walked down the hall into a bedroom, where he started stealing a coin
collection, according to the release. The owner confronted the robber,
who threatened the owner and kept taking the coins, according to the
release. The owner ran to another room, grabbed a handgun and chased
the robber. The owner fired a shot and missed, and the robber drove
off in an SUV. Sheriff's Office spokeswoman Cpl. Robin McIntosh said
she did not know if the shot was fired while they were inside or
outside the home. The homeowner fell while chasing the robber and
suffered minor injuries. His wife, who also was home, was not injured,
according to the release… (It sounds as thought the homeowner followed
Rule Three and kept his finger out of the trigger guard.)

Oops, Wrong House: A teenage burglary suspect remains hospitalized
after he was shot Friday morning while breaking into a home in
southeast Houston, authorities said. The owner of the home in the 8100
block of Gladstone was alone about 10:15 a.m. when he heard noises
coming from the side of the house. After hearing the sound of breaking
glass, the homeowner, 42, grabbed his pistol and went to investigate.
He pulled back a bedroom curtain and was confronted by the suspect,
who was removing shards of the broken glass from the window, police
said. The homeowner was startled and fired a single shot. The suspect
was struck but fled along with two other people. All three were taken
into custody a short time later, police said. The teenager was taken
to Ben Taub General Hospital in critical condition. The shooting will
be referred to a Harris County grand jury, police said. (I hope that
the shot was fired by intent and not as a startle reaction, which
would imply that the homeowner had pled his finger inside the trigger
guard prematurely.)

Oops, Wrong Pigeon: The victim of a robbery attempt shot and killed
one of the robbers in New Eagle [PA] early yesterday, state police
said. Police said William Eyles, 25, of Monongahela, and Cole
MacFarlane, 25, of New Eagle, tried to rob Joseph Gallick, who pulled
a gun and shot Mr. Eyles. Mr. Gallick was treated at Monongahela
Hospital for injuries incurred during the crime. Mr. MacFarlane was
charged with homicide, attempted robbery, conspiracy and criminal
mischief and is in the Washington County Correctional Facility.

Oops, Wrong Car: A Billings [MT] man driving home from work around 5
p.m. Monday spotted his car that had been stolen from him that
morning. He chased the car until it stopped on the 2600 block of
Fourth Avenue South and managed to hold one of the passengers at
gunpoint until police arrived. "He was actually going home from work
at the time of the call," Billings Police Sgt. Scott Conrad said. "It
was a red Suburban. He chases it down and there's four occupants in
the vehicle. Three run. He catches one of the passengers, with one
hand at gunpoint and one hand on the phone calling police dispatch."
Billings police arrived minutes later and ordered the man to the
ground. They took the teen into custody and released the man once they
realized what had happened. Conrad said the boy helped police identify
those who had allegedly stolen the car, and the boy was later
released. "He actually helped in the case," Conrad said. "We do know
who we're looking for." (Conspicuously absent from this report is the
usual "don't try this at home" warning from the local police.
Nonetheless, it might have been more prudent to have called 911 and
simply followed the vehicle until police arrived as there was no
imminent threat to life or limb.)

Oops, Wrong Church: A pistol packing pastor shot and critically
wounded a would-be thief Sunday after the suspect broke into his
church. According to Detroit News reporting partner WXYZ-TV (Channel
7), the incident occurred when the suspect rode his bicycle to the
Westside Bible Church at Seven Mile and Winston. The pastor, a retired
police lieutenant, was called to his church after being alerted by the
burglar alarm company. According to witnesses, the pastor confronted
the suspect and was forced to shoot him after he tried to hit the
minister. The suspect was held until police arrived on the scene.
Oops, Wrong Teenager: A father who attacked his 37-year-old best
friend and roommate with the butt of a shotgun after finding him
having sex with his 16-year-old daughter will not be charged in the
attack. Officials with the [FL] State Attorney's Office declined to
file charges against the Wildwood father in the attack that sent the
37-year-old man and roommate to Leesburg Regional Medical Center with
head injuries. Bill Gladson, a supervisor with the State Attorney's
Office, said the father had the right to use reasonable force to
prevent his daughter from becoming the victim of a sex crime. The
37-year-old also had signed a waiver at the hospital, stating he
didn't want the father charged, according to Wildwood police… The
37-year-old was arrested on seven counts of unlawful activity and sex
with a minor after leaving the hospital on Aug. 24…

Oops, Wrong House: A Lexington [KY] man is behind bars after police
say he tried to break into the wrong home overnight. A man says he was
taking a shower early this morning at his home on West Fourth Street,
when he heard something just outside his house. He told police he went
around to check it out, and saw a man trying to break in through a
window. That's when the homeowner grabbed a gun and held the would-be
burglar at gunpoint, while he called 9-1-1. Police later caught up
with and arrested Donovan Campbell. He's now in jail, charged with
burglary. That homeowner runs a business out of his home, and he says
he was tired of being broken into, so he decided to put a stop to it.

Oops, Wrong House, Illinois Version: Police say an eastern Illinois
man shot two people to death after they forced their way into his home
and tried to rob him. Vermilion County Sheriff Pat Hartshorn says the
two masked men held the homeowner on the floor at gunpoint Monday
night and choked him while demanding money. The sheriff says the
alleged robbers were 22 and 17 but didn't identify them or the
homeowner. Hartshorn says the men let the homeowner go when his wife
said she had expensive jewelry upstairs. While the men focused on a
jewelry box, the homeowner grabbed a handgun and shot them. Hartshorn
says another 17-year-old waited in a pickup outside. He drove away but
was arrested a short time later. Indianola is about 10 miles southwest
of Danville. (All's well that ends well but this is one more incident
that shows that it's best to keep the gun on your person, even inside
your home.)

Oops, Wrong House, Michigan Version: An allegedly drunken man who
entered a Traverse City home in the middle of the night found himself
at gunpoint. Aaron TwoCrow, 24, of Suttons Bay, allegedly entered a
home on the 800 block of Fern Street at about 4:20 a.m. Saturday,
police said. A female homeowner was up rocking her 15-month-old child
in the living room when she heard her kitchen door open and saw a
stranger in the home. "She's just sitting there in the dead of night

forced their way into a Washington County home were greeted by a
homeowner with a shotgun. "It's not a very nice thing to happen in
McDonald, because McDonald is a very quiet town," said neighbor, Don
Feigley. Police said the homeowner, Joseph Tokarksi, who was one of
several people in the house, came down the steps with the weapon in
his hand. "I'm prepared to do what I have to do to protect my home and
my family," said Toarski. "I'm all for that. I think anybody should be
allowed to defend themselves in their homes and defend their
neighbors, if they want to," said Feigley. Police later caught two
suspects whom they indentified as 19-year-old David Carlisle, of

Oops, Wrong Shed: …The homeowner was awakened when he heard noises
coming from his outside utility shed, Amerson said. The 64-year-old
man told deputies he went to investigate and saw Roberts coming out of
the shed carrying a grass trimmer and a chain saw. "The two men got
into a struggle, and then Roberts went to his car to try and get away,
but the car wouldn't start," Amerson said. "He then got out of the car
and told the homeowner he was going to shoot him." Amerson said the
homeowner went inside the house, and Roberts yelled from the yard that
he was going to shoot him. The homeowner then got a 20-gauge shotgun
and shot Roberts in the chest, Amerson said…The homeowner acted within
his rights, said District Attorney Randall Houston. "The bad people
need to realize that folks in Elmore County [AL] have guns and aren't
afraid to use them," Houston said. "A man has the right to protect his
life and his property, and all the evidence gathered in this case
shows that's just what happened." Houston said his office will present
the case to a future session of the Elmore County grand jury, but he
didn't expect any charges would be filed against the homeowner.
Oops, Wrong Driveway: Deputies with the Knox County [TN] Sheriff's
Office responded to a shooting at 837 Lester Road, shortly before 11
p.m. Friday night. Jonathan and Kara Stevens told investigators they
were at home when they heard their pit bulls barking. They armed
themselves with a pistol and flashlight as they went outside to
investigate. The couple told detectives a teenager jumped out from
behind a car in their driveway and pointed gun a 12 gauge shotgun at
them. Jonathan Stevens said he shot the 15 year old twice and believes
the teenager shot at them twice before they ran back into their home.
Neighbors say the suspect collapsed in their driveway after the
shooting. Deputies found the teenager laying in the road with two gun
shot wounds in his upper torso. Rural Metro took the suspect to UT
Medical Center. The homeowners were not hurt…

Oops, Wrong House: A North Syracuse [NY] resident shot and killed two
Syracuse men after they kicked in the front door to his home and
entered early Saturday morning in what police are calling an apparent
home invasion. Dead are Thomas R. Lashomb, 23, of South Midler Avenue,
and Wade A. Brown, 26, of West Matson Avenue, Officer Jeffrey Tripp,
of the North Syracuse police, said. Jeffrey J. Bush, 22, shot both men
with a pistol-grip shotgun as Bush and others struggled with Lashomb
and Brown inside the house at 115 Elm St., Tripp said. During the
struggle, Bush's 2-year-old son slept in another room… Both dead men
have a criminal history… North Syracuse police consider the shooting
deaths to have been in self-defense. No charges were filed by North
Syracuse police, but Tripp said that any charges would be up to the
district attorney's office. "If the district attorney's office feels
they need to, they will put it before a grand jury," Tripp said…

Oops, Wrong Driver: Police said a man acted in self-defense on
Saturday when he shot a 24-year-old who tried to rob him at gunpoint.
"Little did this kid know that this 72-year-old man was a licensed CCW
(carrying a concealed weapon) carrier and he produced his own firearm
and defended himself because he was in fear of his life," said Sgt.
John Sullivan of the Dayton [OH] Police Department. Sullivan said the
24-year-old cut in front of the 72-year-old in the area of Brooklyn
Avenue in Dayton. He said the 24-year-old got out of his vehicle with
an assault rifle, pointed it at the 72-year-old and tried to rob him.
That's when the 72-year-old pulled out his weapon and shot the robber
twice, once in the abdomen and once in the arm. The robber is expected
to survive his injuries. Police didn't expect to file charges against
the 72-year-old. They said the attempted robber would face a charge of
aggravated robbery. (It sounds as though the 72-year-old man with the
handgun was bit more "willing" than the 24-year-old man with the
rifle.)

Oops, Wrong Car: Two burglars attempting to steal a car from a Brevard County [FL] home were held at gunpoint by the homeowners. Matthew Clark, 20, and Justin Sheppard, 19, are facing several charges including burglary and grand theft. Authorities say the pair was burglarizing a home near Titusville on Karen Drive when the homeowners confronted them with a 12-gauge shotgun. The woman and her son held the two until police arrived. Clark and Sheppard are now being held on $5,000 bonds. (All's well that ends well but, had the car thieves been armed and prepared to fight, the outcome might not have been worth whatever portion of the vehicle's value was not covered by insurance. With no immediate threat to life or limb, sometimes it's best to call 911.)

Oops, Wrong Treatment Plant: The Polk County [TN] Sheriff's Office is searching for a suspect after a shootout at the Intertrade Holdings, Inc., facility near Copperhill Sunday evening. According to a news release from the sheriff's department, three employees were working at a water treatment plant in the Cantrell Flats area of the Intertrade facility around 10:30 p.m. Sunday when they spotted a male subject walking on the property. When they challenged the man, he allegedly pulled out a handgun, ducked behind cover and began firing at the employees. According to the news release, one of the employees grabbed a shotgun the workers kept at the facility to defend against coyotes and other predators and returned fire. During the brief exchange of fire, another employee, Larry Breeden, 57, of Cherry Log, Ga., suffered a wound to the neck. He was transported to Copper Basin Medical Center and then to Erlanger Medical Center, and released Monday morning… (It sounds as though it's fortunate that this employer did not ban firearms in the workplace.)

Student Will Not Be Charged in Sword Death: Baltimore homicide detectives don't think a Johns Hopkins University student had "the intent to kill" when he used a samurai sword to confront an intruder behind his home, a police spokesman said Thursday. John Pontolillo, 20, a junior chemistry major from New Jersey, killed the man with a single blow early Tuesday after police said the suspected burglar lunged at him. Mr. Pontolillo has not been charged in the death of Donald D. Rice, 49, who had a long rap sheet of burglary arrests and was released from jail just two days before the altercation. Prosecutors will determine whether charges are appropriate after consulting with police, a process that could take weeks… When Mr. Pontolillo saw Mr. Rice, he raised the sword and yelled for his roommates to call police, Mr. Guglielmi said. Mr. Rice lunged at the student, who backed up against a wall. Bringing a Baseball Bat to a Gunfight: Police say a man shot an intruder who was armed with a baseball bat Tuesday night. Mark Farrell, 24, of Beatty, entered Jim Westman's house armed with a wooden baseball bat, said Klamath Falls Sheriff Timothy Evinger in a news release. Farrell attempted to assault Westman with the bat and Westman fired one round from a .22-caliber rifle, which hit Farrell in the right forearm. Farrell continued to assault Westman after he was shot, Evinger said. Roxann Klobucar, Westman's mother, was able to wrestle the bat from Farrell. Klobucar hit Farrell several times in the head until he was subdued, Evinger said. Prior to entering the house, Farrell damaged Westman's vehicle with the bat, Evinger said. Evinger said the motive appears related to a theft from Farrell about a month ago… (While peripheral hits are often of limited value, this would seem to be even more true of peripheral hits with a .22.)

Oops, Wrong House, Florida Version: Two attempted armed robbery suspects were hospitalized with multiple gunshot wounds after the man police said they tried to rob shot them. According to police, Christopher Young, 38, and William Bell, 31, went into the home of Dane Rollins, 34, early Sunday morning armed with handguns. Police said after the suspects stole cash, Rollins grabbed his shotgun and went after them. The two suspects fled, but police said they later found them with several gunshot wounds. The men were taken to Halifax Medical Center. Rollins was not hurt. Police said shocked neighbors witnessed the entire gunfight. "'Boom, boom, boom!' Then I came outside and hear a neighbor yelling to get out of the house," said neighbor Jonathan Smith… (I have to wonder with what sort of load the burglars were shot and where they were hit. While buckshot and slugs do not guarantee incapacitation, birdshot is not a good choice for self- or home defense, contrary to the advice of many chairborne rangers.)

Oops, Wrong House, Georgia Version: A burglar who broke into a Lithonia home was shot in the buttocks by the homeowner, police said. The burglary happened at about 11:30 a.m. at the home on Gadwell Circle. The intruder was taken to a hospital with moderate injuries, police said. The intruder's name was not released. Investigators said no charges are expected to be filed against the homeowner, who was not identified by police. (The historical basis for my advocacy of shots to the pelvis stems from the NYPD Stakeout Unit, which sought advice from the medical examiner on how to keep armed robbers from taking gunfights out of the businesses they were robbing, onto crowded sidewalks. Jim Cirillo assured me that every felon shot in the pelvic area by members of the SOU fell to the ground. I note that no mention is made of the police having arrested the burglar anywhere other than the home where he was shot.)

Oops, Wrong House, Wisconsin Version: The Dane County Coroner's Office has identified the man killed Wednesday afternoon in an apparent home invasion in Fitchburg as Roberto Vega-Gil, 42, of Madison. Preliminary autopsy results indicate Vega-Gil died of a single gunshot wound, said interim Coroner Kurt Karbusicky. Police said they believe Vega-Gil was trying to break into a home at 2969 Osmundsen Road when he was shot and killed by one of the home's residents, Jamie Chen, 41, shortly before 2 p.m. Wednesday. Vega-Gil is not believed to have been armed at the time he was shot, police said. According to police, Vega-Gil was wearing gloves, and there was evidence of forced entry to the residence… No charges are pending against Chen, who is the son of the home's owners, Peter and Mei Chen, police said.

Oops, Wrong Businessman: Starkville [MS] Police Department detectives say they are tracking several leads in the early Saturday morning robbery attempt that saw the victim fire gunshots at the suspect who tried to hold him up. Around 5:30 a.m. Saturday, the owner of Starkville Ready Cash on Highway 12 West was arriving at the business to prepare to open for the day when a black male approached him, pointing a handgun at him. The owner, whose name SPD detectives would not release amid concerns for his safety, then pulled out a handgun of his own and fired multiple shots at the suspect, but none struck him, said Sgt. Chadd Garnett. The owner had begun carrying the gun after previous break-ins and robbery attempts at the business, Garnett said. The suspect then ran behind the building and fled north toward a neighboring residential area, Garnett said. Nothing was stolen in the robbery attempt, and no one was injured, Garnett said… (All's well that ends well but those rounds that missed the robber all ended up somewhere. It sounds as though some more training may be in order.)

Oops, Wrong House: Hours earlier, someone had broken into John Pontolillo's house and taken two laptops and a video-game console. Now it was past midnight, and he heard noises coming from the garage out back. The Johns Hopkins University undergraduate didn't run. He didn't call the police. He grabbed his samurai sword. With the 3- to 5-foot-long, razor-sharp weapon in hand, police say, Pontolillo crept toward the noise. He noticed a side door in the garage had been pried open. When a man inside lunged at him, police say, the confrontation was fatal. "He was backed up against a corner and either out of fear or out of panic, he just struck the sword with force," said Baltimore Police spokesman Anthony Guglielmi. "It was probably with fear for his life." Pontolillo, who rents the house in the 300 block of E. University Parkway in the Oakenshawe neighborhood, struck the intruder no more than twice, police say, nearly severing his left hand and inflicting what police termed a "spear laceration." The intruder, Donald D. Rice of Baltimore, a 49-year-old repeat offender who had been released from jail only Saturday, died at the bloody scene…

Oops, Wrong Campsite: A camper who shot and killed a 25-year-old Olympia man last month during a bizarre late-night encounter along a remote bank on Wynooche Lake will not face charges. The Grays Harbor Prosecutor's Office announced Tuesday it will not seek charges against the shooter, Gary Bowers, 38, of Port Orchard, in the death of Westin Wolff during the tragic Aug. 29 camping trip. Prosecutor Stew Menefee said all the evidence indicates Bowers fired the fatal shot only after Wolff ignored several warning shots and attacked him with a machete. "We found that the evidence would support it was a justifiable homicide committed in self-defense," Menefee said this morning… (I do not teach warning shots. Among issues to consider is that handguns do not consistently stop people with a single shot and warning shots may waste ammunition that could be needed momentarily. If use of deadly force is not justified, a warning shot is not likely to be justified either.)
