Oops, Wrong Car: Two burglars attempting to steal a car from a Brevard County [FL] home were held at gunpoint by the homeowners. Matthew Clark, 20, and Justin Sheppard, 19, are facing several charges including burglary and grand theft. Authorities say the pair was burglarizing a home near Titusville on Karen Drive when the homeowners confronted them with a 12-gauge shotgun. The woman and her son held the two until police arrived. Clark and Sheppard are now being held on $5,000 bonds. (All's well that ends well but, had the car thieves been armed and prepared to fight, the outcome might not have been worth whatever portion of the vehicle's value was not covered by insurance. With no immediate threat to life or limb, sometimes it's best to call 911.)

Oops, Wrong Treatment Plant: The Polk County [TN] Sheriff's Office is searching for a suspect after a shootout at the Intertrade Holdings, Inc., facility near Copperhill Sunday evening. According to a news release from the sheriff's department, three employees were working at a water treatment plant in the Cantrell Flats area of the Intertrade facility around 10:30 p.m. Sunday when they spotted a male subject walking on the property. When they challenged the man, he allegedly pulled out a handgun, ducked behind cover and began firing at the employees. According to the news release, one of the employees grabbed a shotgun the workers kept at the facility to defend against coyotes and other predators and returned fire. During the brief exchange of fire, another employee, Larry Breeden, 57, of Cherry Log, Ga., suffered a wound to the neck. He was transported to Copper Basin Medical Center and then to Erlanger Medical Center, and released Monday morning… (It sounds as though it's fortunate that this employer did not ban firearms in the workplace.)

Student Will Not Be Charged in Sword Death:
Baltimore homicide detectives don't think a Johns Hopkins University student had "the intent to kill" when he used a samurai sword to confront an intruder behind his home, a police spokesman said Thursday. John Pontolillo, 20, a junior chemistry major from New Jersey, killed the man with a single blow early Tuesday after police said the suspected burglar lunged at him. Mr. Pontolillo has not been charged in the death of Donald D. Rice, 49, who had a long rap sheet of burglary arrests and was released from jail just two days before the altercation. Prosecutors will determine whether charges are appropriate after consulting with police, a process that could take weeks… When Mr. Pontolillo saw Mr. Rice, he raised the sword and yelled for his roommates to call police, Mr. Guglielmi said. Mr. Rice lunged at the student, who backed up against a wall. At that point, Mr. Pontolillo struck Mr. Rice once with the sword, nearly severing Mr. Rice's left hand and causing a severe wound to his upper body. Mr. Rice died at the scene…

…The student was the third Baltimore resident in the past month to draw headlines for a confrontation with an intruder. In August, a man used a baseball bat to bash a man who police say was attempting to rob a Fells Point store for the third time. And this week, an off-duty police officer shot and critically wounded a man who police say had forced him to the ground at gunpoint in his Northeast Baltimore home…

Take That, Big Brother: A gun maker that has been drawing attention with campaigns in the mainstream media is planning new TV and print ads that are likely to gain notice - if not notoriety. Henry Repeating Arms, based in Bayonne, N.J., is one of the few gun makers that advertises to general audiences. Its most recent campaign has been centered on the fact that its guns are made in the United States, at factories in Bayonne and Rice Lake, Wis. A television commercial features factory scenes. A print ad, which shows a hand resting on a Bible as if in court, carries the headline "Henry rifles will only be made in America or they won't be made at all." …The new print ad borrows the Bible from the previous one, with a twist: A man wears a holster with a gun on one side and a Bible on the other. "There is nothing wrong with clinging to your guns and religion," the headline reads, quoting Anthony Imperato, president at Henry, in a clear reference to a remark last year by Barack Obama before he was elected president. Mr. Imperato, in a telephone interview on Thursday, said he planned a "test run of the 'Bible holster' ad" to gauge the response…

Law Professors Debate RKBA, Campus Carry: A diverse crowd of more than 150 people gathered in Forum Hall Wednesday evening to hear the opinions of two law professors as they debated the ever-present topic of gun control in relation to the language of the U.S. Constitution. The audience sat intently as the debate-style information session titled "Guns on Campus? The New Understanding of the Right to Bear Arms" brought two perspectives on the future of the courts' interpretation of the Second Amendment through the research and experience of Raymond T. Diamond, law professor at Louisiana State University, and William Merkel, law professor at Washburn University. The debate, moderated by Michael Kaye, law professor at Washburn University, featured a 14-minute segment each for Diamond and Merkel, along with periods for cross-examination of their arguments…

Pennsylvania Legislator Introduces Firearms Freedom Act: Pennsylvania State Representative Sam Rohrer has introduced the "Firearms Freedom Act" (HB1988) for consideration in the state legislature.    The bill is "An Act prohibiting certain firearms, firearm accessories or ammunition from being subject to Federal law or Federal regulation." HB1988 currently has 48 additional co-sponsors, and according to FirearmsFreedomAct.com, is similar to bills recently enacted into law in both Montana and Tennessee. While the bill seems to focus solely on federal gun regulations, it has far more to do with the 10th Amendment's limit on the power of the federal government.  It specifically states: "The regulation of intrastate commerce is vested in the states under the 9th and 10th Amendments to the Constitution of the United States, particularly if not expressly preempted by federal law. Congress has not expressly preempted state regulation of intrastate commerce pertaining to the manufacture on an intrastate basis of firearms, firearms accessories, and ammunition." …

Ohio GOP Ignores Prohibitionist Candidate: On June 16, 2009, I published an editorial entitled "Will the Ohio Republican Party cement their minority status by backing anti-gun Mike DeWine for Attorney General?" For now, at least, the answer appears to be leaning to "No." The 66-member Ohio Republican State Central Committee officially endorsed four statewide candidates last Friday, but the news was perhaps more notable was who they did NOT endorse… As the Senator from Ohio, DeWine was named among the Top 10 anti-gun U.S. Senators, noting that he was "consistently the only Republican to speak in favor of anti-2nd Amendment legislation on the Senate floor." While the state committee's silence on DeWine is an encouraging sign, there is still time for the party to make a fatal decision, however. At the time the endorsements were announced, Jason Mauk, executive director of the state party, told the Columbus Dispatch "They may look at an endorsement in the attorney general race, but I would expect that to happen toward the end of the year, maybe December, if at all," Mauk said… (Ohio's Republican Party has suffered recently as a result of its longstanding opposition to the RKBA.)

Meanwhile, in Indiana…: …For the next several months I'm going to try to convince our good people to help us retool the Indiana Republican Party so that we can control both the Indiana Senate and House… If gun owners here in Indiana want to again enjoy some meaningful advancement to exercise their right to keep and bear arms then we must regain control of the House back to the Republican Party in order to set up the ability for our prime movers like Sen. Johnny Nugent and Rep. Jackie Walorski and others to have the legislators necessary to assist them in their efforts. I know at the federal level it's hard to distinguish between Democrats and Republicans with some exceptions. Indiana's own Sen. Dick Lugar has been a glaring disgrace with his votes, especially with gun votes. I get calls and e-mails from across the country asking me what is the Republican Party going to do with him when he comes up for reelection…

NRA Targets California Mayor: As a longtime member of the National Rifle Association, Modesto Mayor Jim Ridenour certainly wasn't surprised to receive a recent hit-piece mailer on a local politician from the pro-gun organization. The NRA routinely flexes its considerable muscle to combat anyone who advocates gun control in virtually any form. Ridenour was surprised, however, to be its target. Your mayor - Jim Ridenour - joined a national anti-gun group, reads a bright- orange postcard he and every other NRA member in Modesto likely received. Urge him to quit the Bloomberg coalition today. What suddenly made him so toxic? A couple of years ago, Ridenour attended a conference in Washington, D.C., for the nation's mayors. He was invited to join Mayors Against Illegal Guns, an organization co-chaired by billionaire New York Mayor Michael Bloomberg and Boston Mayor Thomas Menino. It began with 15 mayors and quickly grew to more than 450, according to MAIG spokesman Jason Post… (It's easy for a politician to buy a membership in the NRA. However, walking the walk is not the same thing as talking the talk.)

Florida Mayor Targeted by NRA: The National Rifle Association is taking aim at some mayors nationwide, including Ormond Beach's Fred Costello. He and 450 other members of Mayors Against Illegal Guns are being pressured to quit the organization that has a stated mission of "preventing criminals from illegally obtaining guns and preventing those who do from using them." Costello said he has received many e-mails lately labeling him a gun-control advocate. He is the organization's sole mayor in Volusia and Flagler counties, and one of 40 in Florida. "The National Rife Association is basically trying to make mayors look like they are against all guns," Costello said. "And that's absolutely not true." The NRA's Institute of Legislative Action in a letter calls Mayors Against Illegal Guns "an activist anti-gun front group." The NRA campaign is calling for mayors to quit the organization that was founded in 2006 by New York City Mayor Michael Bloomberg and Boston Mayor Tom Menino…

Californians – Call Your Governor: A new law affecting every Californian regarding pistol ammunition purchases stands to put shooters' rights under siege once again. All gun owners need to immediately contact the Governor's office and highly "suggest" that he not sign any more anti-ammunition/anti-gun legislation into effect. Concerned citizens can send an e-mail to the governor's home page at www.gov.ca.gov/interact. Type your name and e-mail address, select 'gun control' under "Choose your subject," hit submit and then write your message. You can also call or send a fax to his lordship's office at 916-445-2841 or fax at 916-558-3160…

Thai Government Arms Civilians: With an insurgency threatening to worsen, Thailand's military is turning to civilians like Nipa Waya to return fire in the three southern provinces close to the Malaysian border. Nipa, a single mother, maintains a vigil through the night armed with a shotgun at the entrance to a Buddhist village on the outskirts of this southern city. With her, on a recent night, were 15 other men and women, similarly armed, who are part of a civilian-defence force… Nipa, a Thai Buddhist, welcomes the move by the Thai military to recruit civilians to combat the shadowy network of Malay Muslim insurgents responsible for the violence that has erupted since early 2004 in the southern provinces of Yala, Narathiwat and Pattani…

Tangentially Related: There would be no screaming at Rand Cardwell's meeting tonight, no histrionics, no playing to the cameras. The atmosphere was PTA. Garden Club. Kiwanis. Cardwell had called this second meeting of the local chapter of Oath Keepers, and on a recent Tuesday night about 16 of his fellow Tennesseans trickled into a suburban Town Hall community room. Now they sat quietly around some folding tables, with all eyes on Cardwell, the chapter president. Cardwell, a 48-year-old laid-off aluminum plant worker, was new to this activism stuff, but he wasn't nervous. He'd led enough meetings back in his days as a Marine Corps sergeant… Founded this year by Stewart Rhodes, a Yale-educated lawyer and former staffer of Rep. Ron Paul (R-Texas), the group calls itself nonpartisan and features on its website a 1776 quote from George Washington warning of an incipient moment that would determine whether Americans will be "Freemen, or Slaves; whether they are to have any property they can call their own; whether their Houses, and Farms, are to be pillaged and destroyed." …

Oath Keepers is a non-partisan association of currently serving military, reserves, National Guard, peace officers, and veterans who swore an oath to support and defend the Constitution against all enemies, foreign and domestic … and meant it. Our oath is to the Constitution, not to the politicians, and that oath will be kept. We won't "just follow orders." Below is our declaration of orders we will NOT obey because we will consider them unconstitutional (and thus unlawful) and immoral violations of the natural rights of the people. Such orders would be acts of war against the American people by their own government, and thus acts of treason. We will not make war against our own people. We will not commit treason. We will defend the Republic…
