How Common Are Firearm Injuries?: With tragic stories like the one
below, it is tempting to believe that banning guns would make the
world safer. But just as keeping the finger off the trigger and not
pointing a gun at somebody would have saved this boy's life, basing
public policy on unsubstantiated, emotional reaction can create
unintended consequences… Between 1984 and 2006 (latest data available)
the Centers for Disease Control (CDC) recorded a 69.6% drop in the
rate (per 100,000 population) of accidental firearms fatalities.
During the same time period, the accidental non-firearms fatality rate
increased 0.2%. Moreover, in 1984, accidental shootings accounted for
1.2% of all fatal accidents; by 2006, firearms comprised 0.4%, a 69.4%
drop…

Bad Ruling in Kansas: …And the court concluded that while this allows
self-defense that involves an actual attack on the attacker - for
instance, hitting, shooting, or stabbing the attacker - it does not
allow self-defense that merely involves a threat of violence against
the attacker. I think the dissent is right to say that "force" can
reasonably be read as including "constructive force" such as threats,
especially in light of the substantial American legal tradition of
reading force this broadly (and despite the fact that other Kansas
statutes generally do say "force or threat" or some such). And this is
especially so because, as the dissent points out, the result is
absurd: Restraint in the use of defensive violence is rewarded by
criminal punishment. I believe courts should generally read statutes
as written, but the should also read their terms against the backdrop
of the legal rules that help define these terms, and principles such
as the rule of lenity, and the presumption against readings that
produce absurd results… (This is why states such as Arizona and
Montana are passing statutes that authorize the defensive display of a
firearm, under defined circumstances. The Arizona statute lists
telling an aggressor that you are armed as a form of "dsiplay.")

The Beat Goes On: A new Gallup poll may explain recent reports of
increased gun and ammunition sales in the U.S. Majorities of those who
personally own a gun (55%) and of those with a gun in the household
(53%), as well as 41% of all Americans, believe that President Obama
"will attempt to ban the sale of guns in the United States while he is
president." …Gallup's question documents that for a majority of gun
owners, the belief that the president intends to try to ban the sale
of guns is apparently quite real. One is reminded of the sociological
principle that if people believe a situation to be real, the
consequences are real - whether or not that belief is factually
correct. Thus, although the survey did not ask directly whether those
who hold the belief that Obama wants to ban gun sales have acted on
that belief in terms of increased purchases of guns and ammunition, a
connection between the belief and the behavior is a logical
hypothesis… (And we're supposed to ignore such statements as Barbara
Boxer's, that she will move to reinstate a federal ban on "assault
weapons" at a time of her choosing.)

Michigan Instructor Offers Women-Only CPL Course: Lee Zeidler was calm
as he spoke to the women, each armed with a pistol, ready to fire.
They stood nervously on the line at the Caledonia Sportsman's Club
pistol range. The pungent smell of gunpowder hung in the air. They
were a mixed group of women, from their early 20s to mid-60s, all
prepared mentally and emotionally for the next step. Most had come to
learn how to defend themselves. Others feared losing that right some
time in the future… Klemkosky is among 50 women who signed up for the
required course to obtain a license to carry a concealed handgun in
Michigan. The female-only class was sponsored by Great Lakes Outdoors
Foundation, a 2-year-old nonprofit organization with Zeidler as
executive director… Michigan women are increasingly looking to carry.
Zeidler said 25 percent of the state's 211,000 concealed weapons
permit holders are female…

California Sheriff Issuing More CWP's – Sort Of: Sacramentans are
arming themselves in increasing numbers, statistics from the
Sacramento County Sheriff reveal. Applications approved by the sheriff
to carry a concealed weapon have increased more than 500 percent from
2008, statistics show. By September 30, the department had approved 37
applications to carry a concealed weapon, compared with six approved
applications in 2008. The sheriff also has been denying applications
in increasing numbers: 25 applications were denied by September 30,
compared with 10 permit denials in 2008. Overall, the sheriff had
approved or denied 62 concealed weapon permits by October, nearly four
times as many as had been processed through 2008. Earlier this year,
Sheriff John McGinness said he would consider issuing more concealed
weapons permits as the Sheriff's Department faced steep budget cuts
that would lay off hundreds of deputies. "I have to be open to the
potential that there will be more people in need of the ability to
protect themselves as individuals," he said in May… (CCW in Sacramento
County is a longstanding issue. California law used to allow a citizen
to receive a CWP from the sheriff or any police chief in the county of
his residence. When the chief in Isleton began issuing on a
shall-issue basis, back in the 90's, offering area residents a pathway
around the restrictive policies of the sheriff's department,
legislators revised the statute, limiting issuance to the sheriff or
the chief in one's city of residence; they also added a training
requirement.)

Open-Carry Demonstration with a Twist: A group of Adopt a Highway
volunteers were packing more than trash along the shoulder of
Minnesota 55 in Mendota Heights on Sunday morning. With legal guns on
their hips, a dozen area residents spent nearly three hours picking up
litter - everything from cigarette butts to blown-out tires - along a
2-mile stretch of the highway just east of the Mendota Bridge. It was
the inaugural event for the group, which registered with the Minnesota
Department of Transportation's Adopt a Highway program under the name
Minnesota Carry Permit Holders. "We believe this is the safest stretch
of road right now in the state," said Jason Walberg, who collected
trash with a Springfield XD .40-caliber, semi-automatic handgun

Oath Keepers Conclude Successful Convention: I just received the
following email from Oath Keepers founder Stewart Rhodes under the
subject title "Pretty favorable article about Oath Keepers Conference
in Las Vegas Review Journal‏" …In spite of attempts by some to paint
Oath Keepers as the opposite of what they stand for, the movement is
gaining notice, interest and members. That has to infuriate and worry
the detractors. It ought to encourage those of us who believe
supporting and defending the Constitution against all enemies, foreign
and domestic, is a good thing.

No amount of controversy will keep Oath Keepers from educating people
about what it means to support and defend the Constitution. That was
the message Saturday during the kickoff of the group's inaugural
national conference, a two-day event that comes at a time when Oath
Keepers is experiencing a surge in membership and notoriety. Started
earlier this year by Las Vegas resident Stewart Rhodes, Oath Keepers
is a nonprofit organization made up primarily of current and former
police and military personnel who renew their oaths to the
Constitution… By honoring the Constitution, Rhodes said, the United
States will never become Nazi Germany or again allow abuses like the
detention of Americans of Japanese descent during World War II. The
group has close to 2,000 dues-paying members, twice the number it had
last week, said Dave Freeman, a board member and the group's national
peace officer liaison… "My oath to the Constitution is to provide
protection and welfare for the citizens of this country," said Black,
a federal air marshal who has filed numerous whistle-blower complaints
against the Transportation Security Administration. "I think all law

.380 or the 9x18mm Makarov cartridge but I'm a bit skeptical about a

Shotgun and rifle crime has more than doubled in Scotland because
police have been so effective in cracking down on handgun smugglers,
it emerged yesterday. Gangs finding it harder to access the smaller
weapons are instead arming themselves with shotguns and rifles stolen
from licensed holders. The Scottish Crime and Drug Enforcement Agency
says that a recent rise in illegal handgun trade led officers to crack

Shades of Alfred Nobel?: Approaching 90, the inventor of the
Kalashnikov assault rifle has one big regret: The almost unstoppable
Kalashnikov, designed in 1947, has become the weapon of choice for
militants and rebels from Liberia to Afghanistan as well as gangsters
and drug traffickers. "It is painful for me to see when criminal
elements of all kinds fire from my weapon," Mikhail Kalashnikov said
in a videotaped address to a conference of Russian arms traders and
designers at a top-secret Soviet-era arms testing facility outside
Moscow… Kalashnikov made it clear in the video that he never foresaw
the firearm's global reach. "I created this weapon primarily to
safeguard our fatherland," he said, looking frail and weak and with
his eyes watery. Designed just after World War Two to work in the
harsh conditions in which Soviet troops operate, the gas-powered
Kalashnikov, which is cheap to build and easy to maintain, became one
of the most successful weapons ever produced… (It may be worthy noting
that Kalashnikov prefers to view himself as a Russian patriot, not an

Tangentially Related: A new Gallup poll shows that conservatives
outnumber moderates for the first time since 2004. Gallup's breakdown
shows that 40 percent of Americans call their political views
conservative, 36 percent moderate and 20 percent liberal. Last year,
conservatives were tied with moderates at 37 percent. So what put
conservatives into the lead? Independents, apparently. Now, 35 percent
of them are self-proclaimed conservatives, up from 29 percent last
year. Meanwhile, the portion of independents who call themselves
moderate dipped to 43 percent from 46 percent… (To paraphrase Mordan
Claude, Robert Heinlein's character who states, "…an armed society is
a polite society," this is a personal observation only: While reading
the news every day reminds me more and more of the scenario painted by
Ayn Rand in Atlas Shrugged, I remain optimistic. Never in the history
of our nation have so many private citizens purchased so many firearms
and so much ammunition. Doing so is a radicalizing experience for many
new gun owners. Having come to the realization that they cannot rely
on the government for personal protection, most will eventually begin
to question whether it makes any more sense to rely on the government
for their retirement, their health care, ad infinitum. Further, some
believe that we are now experiencing a "Roe effect." This is a
function of left-leaning people having used abortion to decrease their
production of offspring to a much greater extent than right-leaning
people. Since the values of children are usually shaped by those of
their parents, this would mean more right-leaning voters over time.

Oops, Wrong House: An intruder broke into a home on Oscar Smith Drive
in San Marcos [TX] Wednesday night and came out of the adventure with
several gunshot wounds from a resident of the home. San Marcos police
are investigating. Police responded to a call of someone trying to
break into a home in the 700 block of Oscar Smith Drive. Three
residents were inside when a man forced his way into the home through
a back door. The suspect was armed with a BB gun resembling a real
pistol. One of the residents fired numerous shots from a handgun,
striking the intruder.  The man fled on foot. Shortly after the 9:50
p.m. incident, a man arrived at Central Texas Medical Center (CTMC)
with several gunshot wounds. He received primary treatment at the CTMC
Emergency Room and was transferred to the University Medical Center at
Brackenridge in Austin. The man was reported to be in stable condition
Thursday morning…

More Details on Ohio Shooting: When an armed robber barged into a
North Side motel room Wednesday night and ordered the six people there
to the floor, he put a 70-year-old woman closer to her handgun. The
great-grandmother knelt between the beds, reached into her purse on
the floor and pulled out her .357 Magnum pistol. She fired one shot at
the robber, who staggered from the room, collapsed in the parking lot
and died. "It's a wonder she didn't shoot us all," said her
51-year-old son, who was preparing to hand over his cash when he heard
the gunshot. "She's the worst shot in the world. She said to me, 'God
was with me tonight. You know I couldn't have done that myself.'" …

holsters, until bedtime. Then they go into my shoes, alongside the
bed, where they remain within reach, as do a pair of flashlights,

reporting that the defender has concealed carry license, and that the
deceased attacker had a criminal history. However, in the accompanying
video, the announcer leads with: "Police say a 70-year-old woman took
the law into her own hands last night." Here is how Sergeant Weiner
responded to the question: Did you tell reporters the lady "took the
law into her own hands?" No. That phrase is not a fair and accurate
depiction of what happened. She was simply defending herself. Had the
perpetrator been arrested, he would have been charged with robbery.
Also, when a perpetrator forces his way into a dwelling with a gun –
it doesn't matter if he forced his way into an apartment, hotel room,
or a house – we would also charge him with kidnapping." …

U.S. Representative Bobby Rush (D-Ill.) recently sponsored H.R. 45,
also known as "Blair Holt's Firearm Licensing and Record of Sale Act."
The bill is, at its core and as its name implies, a licensing and
registration scheme.
The measure calls for all handgun owners to submit to the federal
government an application that shall include, among many other things:
a photo; an address; a thumbprint; a completed, written firearm
safety test; private mental health records; and a fee.  And those are
only some of the requirements to be licensed!

The bill would further require the attorney general to establish a
database of every handgun sale, transfer, and owner's address in
America.  Moreover, the bill would make it illegal to own or possess a
"qualifying firearm" -- defined as "any handgun; or any semiautomatic
firearm that can accept any detachable ammunition feeding device…"
without one of the proposed licenses.

Additionally, the bill would make it illegal to transfer ownership of
a "qualifying firearm" to anyone who is not a licensed gun dealer or
collector (with very few exceptions), and would require "qualifying
firearm" owners to report all transfers to the attorney general's
database. It would also be illegal for a licensed gun owner to fail to
record a gun loss or theft within 72 hours, or fail to report a change
of address within 60 days.  Further, if a minor obtains a firearm and
injures someone with it, the owner of the firearm may face a
multiple-year jail sentence.

H.R. 45 is essentially a reintroduction of H.R. 2666, which Rush
introduced in 2007.  H.R. 2666 contained much of the same language as
H.R. 45, and was co-sponsored by several well-known anti-gun
legislators--including Barack Obama's chief of staff, Rahm Emanuel.
H.R. 45 currently has no co-sponsors.

In the last few weeks, NRA-ILA has received hundreds of e-mails
warning us about "SB-2099," a bill that would supposedly require you
to report all your guns on your income tax return every April 15.

Like many rumors, there's just a grain of truth to this one.
Someone's recycling an old alert, which wasn't even very accurate when
it was new.

There actually was a U.S. Senate bill with that number that would have
taxed handguns - nine years ago.  It was introduced by anti-gun Sen.
Jack Reed (D-R.I.), and it would have included handguns under the
National Firearms Act's tax and registration scheme.  This has nothing
to do with anyone's Form 1040, of course.

Fortunately, S. 2099 disappeared without any action by the Senate,
back when Bill Clinton was still in the White House.  We reported
about it back then, just as we report about new anti-gun bills every
week.  Now, it's time for gun owners to drop this old distraction and
focus on the real threats at hand.

From GOA: Congratulations! You have stymied the shady tactics used by
Barack Obama, Harry Reid, and Nancy Pelosi to try to pass the
ObamaCare bill and - in the opening salvo of the battle - you blew
them out of the water… As you remember, the ObamaCare bill would dump
your gun-related health data into a federal database.  It would also
put your (government mandated) insurance at risk if you keep a loaded
gun for self-defense. But there was a problem:  The anti-gun health
bills cost too much, and Obama had promised to pass a bill which would
not raise the deficit by "one penny." So what Obama, Reid, and Pelosi
did was to try to pass a separate bill (S. 1776) which would fund the
anti-gun ObamaCare bill by raising the deficit another $247 billion
dollars… With gun owners responding vigorously to our alerts on this
issue, the motion to invoke "cloture" (or shut off debate) on the bill
failed by a 47-53 vote - 13 votes short of the 60 votes the anti-gun
socialists needed. The victory on S. 1776 means that it will be much
harder for Obama, Reid and Pelosi to pick up the somewhat
fiscally-minded Blue Dog Democrats they so desperately need to get
their anti-gun ObamaCare legislation passed. So congratulations!  It
is true that this is only the first battle... but, if we continue
battering Congress as we have, it will be the first of many victories…

LEOSA Clean-Up Bill: Congressman J. Randy Forbes (VA-04) introduced
public safety legislation that will promote the responsible use of
firearms in the United States by reforming regulations on retired law
enforcement officials' right to carry concealed weapons. The bill, the
Law Enforcement Officers Safety Act of 2007 (H.R. 2726), will
modernize federal firearms laws to ensure that individual liberties
are upheld and public safety is protected… Under current law, retired
law enforcement officers must carry the required documents, including
state-issued documentation verifying the officers' firearms
qualifications, in order to carry a concealed firearm. However, some
states have refused to issue this documentation. This legislation
would provide an alternative to a state-issued document and would
allow retired law enforcement officers to carry a certification from a
firearms instructor stating that they meet the active duty standards
for qualification in firearms training as established by the
regulating agency in that state. This would allow retired members of
law enforcement that left their agency in good standing to carry a
concealed weapon. Additionally, this bill would amend federal criminal
code to include Amtrak and executive branch police officers as
qualified law enforcement officers eligible to carry concealed
firearms… (Illinois, in particular, has been recalcitrant in offering
its retirees the programs to document annual handgun "qualification,"
as required under LEOSA. At least initially, Illinois did not even
have a state "qualification" standard. Yes, the whole concept is
elitist – I don't require any reminders of that fact. It is also,
contrary to the claims of some of its backers, a poor model for the
rest of the population because of the inclusion of federal standards.)

Amtrak Whines: Amtrak is raising serious objections to a proposal that
would allow passengers to stow unloaded guns in their checked baggage,
saying the train operator cannot screen passengers' bags the same way
airlines do.  The Senate passed a measure last month that would allow
passengers to declare and check a weapon on the trains, something
airline passengers can do now, provided the weapon is unloaded and in
a hard and locked case.  But Amtrak and some House members are against
the idea. The House did not include the provision in their version of
the bill approved by the Senate… Amtrak Police Chief John O'Connor
said it's possible the system's random bag inspections could catch
someone with an illegal weapon, but that Amtrak does not even have
baggage cars on every train. He said he does not want any weapons,
checked or unchecked, on his trains. But supporters see the measure as
way to keep Second Amendment rights from being restricted…

Why Don't We See This from Big-City Papers?: Felonious behavior is
becoming more dangerous, if two recent incidents are any indication…
In the second incident, the assailant was shot by someone who
qualifies under the conceal and carry law. Sheriff Greg White is a
proponent of the conceal and carry law, passed by lawmakers in 2003
after Missouri voters rejected a similar law in 1999. The law requires
people to attain a standard of proficiency with weapons before they
are permitted to carry a concealed gun. Proponents of the law believe
it offers a greater sense of security and decreases crime by prompting
felons to consider the consequences of armed confrontation. We confess
to harboring some reservations about the concealed carry law. Our fear
was an increase in guns in public would result in more guns being
displayed prematurely and/or more accidents. White said recently: "All
the fears over conceal and carry have never manifested." We concede
the point. Anecdotal evidence does not suggest an increase in
accidents or unprovoked gunplay. The evidence, however, does show
people defending themselves from harm. The message being sent to
felons is don't bring a weapon to a crime unless you're prepared to
accept the risk. (Emphasis added.)

Georgia Students Debate RKBA: The College Republicans and Young
Democrats held their second annual debate on Wednesday, addressing gun
control and health care reform. "We simply had to do health care
because of the prominent national debate and because it's the most
pressing issue at the moment," College Republicans President Scott
McAfee said. "As for gun control, we were looking for a
'perennial'-type issue, one that always seems to be on the national
radar and interests many people." During the event, one representative
from both of the parties engaged in debate on one of the topics… "The
most common sense argument against gun control is that thugs and

California Ammo Bill – What's the Next Step?: …But all that has been
discussed elsewhere already.  My new concern is that this law will
come to be seen as "a good first step"--and remember, to the forcible
citizen disarmament lobby, every new restriction is "a good first
step." …Straw purchasers" of ammunition, though, will be much more
difficult to prosecute - unless (we will inevitably be told, when
criminal gun use is inevitably unaffected by AB 962) ammunition is
also required to have serial numbers, with those numbers stored in a
database.  As it turns out, an effort has been underway to implement
just such a plan-  - "Ammunition Accountability" legislation.
Although passed nowhere yet, efforts have been made (led, in large
part, by the company that stands to profit enormously from passage of
such laws) in at least 18 states, including California, which given
the state's seeming unwillingness to come in at second place in
anti-gun tyranny (just ask the Brady Campaign), is the obvious best
bet for first state to pass it…

RKBA Infringed in Nevada, Part 1: Is it possible that Nevada
legislators who claim to support the Second Amendment actually oppose
it?  When one looks at state laws and the Nevada Constitution, it
becomes apparent that either state legislators have never understood
the intent of the Second Amendment, or they are in fact hostile toward
it… The wording of the Nevada Constitution suggests it could be used
to attempt to circumvent the original intent of the Second Amendment.
State and local governments appear to have exploited this discrepancy
to enact gun laws that infringe on Second Amendment rights. From Clark
County's registration and waiting-period laws to state-level
background checks and the unconstitutionality of concealed-weapon
permits, Nevada's gun laws restrict individual liberty and allow the
government to usurp more power than what it is granted by people

Oops, Wrong House: An intruder broke into a home on Oscar Smith Drive
in San Marcos [TX] Wednesday night and came out of the adventure with
several gunshot wounds from a resident of the home. San Marcos police
are investigating. Police responded to a call of someone trying to
break into a home in the 700 block of Oscar Smith Drive. Three
residents were inside when a man forced his way into the home through
a back door. The suspect was armed with a BB gun resembling a real
pistol. One of the residents fired numerous shots from a handgun,
striking the intruder.  The man fled on foot. Shortly after the 9:50
p.m. incident, a man arrived at Central Texas Medical Center (CTMC)
with several gunshot wounds. He received primary treatment at the CTMC
Emergency Room and was transferred to the University Medical Center at
Brackenridge in Austin. The man was reported to be in stable condition
Thursday morning…

More Details on Ohio Shooting: When an armed robber barged into a
North Side motel room Wednesday night and ordered the six people there
to the floor, he put a 70-year-old woman closer to her handgun. The
great-grandmother knelt between the beds, reached into her purse on
the floor and pulled out her .357 Magnum pistol. She fired one shot at
the robber, who staggered from the room, collapsed in the parking lot
and died. "It's a wonder she didn't shoot us all," said her
51-year-old son, who was preparing to hand over his cash when he heard
the gunshot. "She's the worst shot in the world. She said to me, 'God
was with me tonight. You know I couldn't have done that myself.'" …

When Guns Are Outlawed…: Gun Crime in Britain has risen by a shocking
35 per cent in just 12 months. Figures today show there were 10,000
incidents involving firearms recorded by the police last year - almost
half of them in London, with 11 incidents a day. The rise is far worse
than predictions which put the increase at 20 per cent. The startling
jump in firearms offences generally is being driven by a 46 per cent
surge in the use of handguns - now seen as fashion accessories in some
inner cities. The figures, compiled by police forces in England and
Wales, also show that overall crime went up by 9.3 per cent in the 12
months to September 2002. Domestic burglary was up 7.9 per cent and
all major categories of crime rose. But it is the figures on guns that
make the most disturbing reading and deal a blow to New Labour's

The government has decided to maintain the present tight gun control
despite a call for liberalizing the regulations on owning lethal
weapons to help people defend themselves. Legislator Yu Tien of the
opposition Democratic Progressive Party urged the government yesterday
to follow the U.S. practice of easing the rules to allow law-abiding
citizens to own handguns to protect themselves. Yu said that gun
smuggling is "quite common" in Taiwan, which he said not only enables
gangsters and the wealthy to buy guns easily but also boosts the price
of illegal firearms on the black market. Possession of firearms by the
general public would be a great deterrence against mob activities, he
claimed. In response, Minister of the Interior Jiang Yi-huah said the
government will not consider legalizing gun ownership by the country's
citizens. Jiang said the disadvantages of allowing private gun
ownership far outweigh the benefits and that the ministry may only
consider allowing guards at security firms to carry firearms because
of the special nature of their jobs…

Interesting Point: The news is atwitter about the arrest of Tarek
Mehanna for various terrorism related charges. Supposedly, one of his
ambitions was to shoot up a shopping mall (maybe ol' Tarek finds mall
music even more maddening than I do)… Some, of course, may argue that
Mehanna's group's inability to acquire the desired firepower
illustrates the effectiveness of "strong gun laws" in Massachusetts.
But wait - are we not constantly told that "strong" gun laws in one
state are undermined by "weak" gun laws in other states?  Isn't that
claim, in fact, the justification given for adding new federal gun
laws?  If, as we are incessantly told, gun shows are "arms bazaars for
terrorists and criminals," couldn't an aspiring terrorist just go to a
state with "weak" gun laws, go to a gun show, exploit the "gun show
loophole," and find an unscrupulous private seller (gun shows are
positively rife with them, I hear) who wouldn't care that the buyer
was not a resident of the state, and buy all the so-called "assault
weapons" he wanted? The answer, obviously, is that a would-be
terrorist could do exactly that, if our supposedly "inadequate gun
laws" were really the boon for terrorists we are constantly told they
are.  In reality, though, the American public is being lied to,
repeatedly, relentlessly, and in furtherance of the agenda of forcible
citizen disarmament.

Suit Challenges Gun Ban in Florida Public Housing: …In July, the House
Financial Services Committee adopted an amendment to allow guns in
public housing projects as part of a markup of a housing bill (HR
3045), which has yet to be passed through Congress. But despite the
seemingly national groundswell in favor of gun ownership, Johnie E.
Lewis, a 73-year-old man living in public housing in Fernandina Beach,
could face eviction for his desire to bear arms. Under a Housing
Authority of Fernandina Beach lease agreement that tenants must sign,
they agree not to display, use or possess any firearms under penalty
of eviction - for now, anyway. Lewis, along with his attorney Steven
M. Fahlgren, filed suit in September for declaratory and injunctive
relief against Patricia Woody in her official capacity as executive
director of the Housing Authority of Fernandina Beach concerning his
right to keep a gun in his home for lawful purposes… "Florida law says
that essentially, a man's home is his castle," Fahlgren said. "He has
the right to use deadly force in his home when attacked." When asked
whether the lease agreement preventing the lawful possession of guns
is binding, Fahlgren said it can't supercede constitutional law…

More Details on Jefferson City MO Shooting: My bro, nascar3n8fan was
at a lawyer friend's downtown Jefferson City office for a get together
with some friends. The robber, a convicted violent felon, held 6 men
at gun point and ordered them face down on the floor and began robbing
them. nascar3n8fan was shot three times once in the chest above his
heart and once in each hand while drawing his conceal carry weapon.
His hands and arms are very badly injured and will require much
surgery to repair. Despite the damage he was still able to get off a
shot which vertually took off the attackers hand ending the
confrontation. His chest wound luckily missed vital organs and exited.
Please keep him and his family in your prayers. He is going to have a
long road to recovery.

**UPDATE**

Justin is at the University of Missouri hospital recovering and is in
good spirits. He underwent surgery on his hands yesterday afternoon
and surgeons tell us that the operation went very well. His hands
absorbed two shots intended for his chest as he was drawing down. The
.38 bullet entered through the knuckles on his right hand and exited
out of his arm which has been extensively pinned and wired back
together. They are confident that in time he wlll regain full use of
both of his hands. If everything goes well he could be released from
the hospital in two or three days. I would like to thank everyone for
their prayers and support it really means a lot to Justin and his
family especially maintaining a positive attitude during this
difficult time.

(The list member who furnished this link commented that the incident
points out why empty-chamber carry is not suitable for an emergency
response as this individual would likely not have been able to rack
the slide, to chamber a round. Arguably, it also points out an
advantage to pistols with short, light trigger strokes as a long
trigger stroke on the order of eight to twelve pounds may not be
feasible either, if you have been shot in the hand or arm. As a
result, I am including the next item today, which I had intended to
save for Sunday.)

Ron Avery on Trigger Pull: … What makes a trigger unsafe is the way
the person is handling it and their values, experience, and training
or lack thereof. I have seen ADs with every trigger weight so the
weight is not really the culprit in the rate of ADs. What I do see as
a problem is the lack of respect and awareness given to the gun and
the way it is used in the field. There is no "gun culture" in the
majority of departments where skill at arms was encouraged as a way of
life. There are individuals or small groups who do participate in the
lifestyle of shooting as a way of life but not as a department. Too
many times, in real world, tense situations, I've had officers and
others behind me with the gun pointing at my back, finger on the
trigger and no clue as to what they were doing. They do not live the
safety rules as taught to them by the range staff. Many have an over
inflated sense of their skill and awareness of gun safety in dynamic
situations and are very unsafe in their gun handling. This represents
a lack of commitment to safety on the part of the person concerned and
is a very real problem in law enforcement as well as other gun
carrying professions. Then you have those who practice unsafe gun
handling in patrol rooms and elsewhere and have negligent discharges.
Some administrative types have reasoned that if you make the triggers
heavier, the problems will magically go away. Not true. This is a
software problem, not a hardware problem. Recognize and reward
firearms proficiency and safety as a value that is practiced,
supported and enforced from the top down. Reward excellence and have
meaningful consequences to those who are careless or reckless and your
problems will largely go away… (There is another perspective, perhaps
best articulated by Massad Ayoob. If you are involved in an incident
with a firearm with a short-stroke, light trigger pull, it makes it
easier for plaintiff's attorney to convince a jury in a lawsuit that,
due to the "hair trigger" on the gun, it was not an intentional
shooting but a negligent one. Generally, homeowner liability policies
exclude intentional acts so that million-dollar liability policy
creates a big incentive for personal-injury attorneys to insist that
the discharge of the firearm was not intended. Personally, I will
continue to carry my double-action revolvers because, under stress, I
have found that I shoot better double-action.)

Ammo for Barter?: …If ammo were being used as money, today, we'd be in
a deflationary period. The ammo presses are not physically able to
"print" enough. What ammo is being printed is quickly purchased and
shot off or saved for the future. The only banking system is in
personal physical storage where owners do not loan it back into the
money supply. That takes it completely out of circulation. To make
matters worse the ammo that is shot off is only partially recycled to
bring it back into the money supply. And more and more new gun owners
are buying their first 200 rounds to practice with their favorite new
security tool. The net effect is that one unit of ammo can now
purchase more goods and services. If you had been using ammunition as
money and savings you would have tripled the return you received on
the equivalent amount of dollar savings over the last year. In fact,
if you substitute ammo for dollars it turns out the deflationists were

North Carolina Shooters Form Club: Area residents with a gun-related
hobby in their sights have a new outlet available to trigger that
activity, the Take Aim Shooting Club. The group is in the
organizational stages and already has met once, according to Tina
Swaim, who is chairing its board of directors. "We've had a lot of
interest," she said, with 20 to 25 members signed up so far. Swaim
recently has been involved with Women on Target and Women in the
Outdoors clinics that encourage their participation in
firearms-related and other activities not normally available. However,
the Take Aim Shooting Club is a co-ed organization open to men, women
and children. "It's something families can do together," Swaim said of
a shooting hobby - a relatively inexpensive pastime for a family
compared to forking out "50 to 60 bucks on a movie for a couple of
hours." The group will meet monthly at Rabbit Ridge Enterprises, a gun
business just across the state line in Ararat, Va., where the
facilities include pistol and rifle ranges. The club's next gathering
is scheduled there on Nov. 1 at 2 p.m…

Tangentially Related: Tennessee is urging 49 other states to come
together and create a "joint working group between the states" to
combat unconstitutional federal legislation and assert state rights.
Tennessee Gov. Phil Bredesen signed HJR 108, the State Sovereignty
Resolution on June 23. According to the Tenth Amendment Center, the
resolution created a committee to form a joint working group between
the states to enumerate the abuses of authority by the federal
government and seek repeal of imposed mandates. State Rep. Susan Lynn
recently wrote a letter to the other 49 state legislatures, inviting
them to join the group and warning that the role of the federal
government has been "blurred, bent and breached." …

Oops, Wrong House, Oregon Version: Police have arrested a man after a
woman was sexually assaulted in her own home in Forest Grove, just
west of the Portland suburb of Hillsboro…  KATU's investigation has
uncovered that Elliott is a 53-year-old transient. The woman was 23
years old, and was asleep in her home at the time. We're told that the
woman grabbed a 22-caliber rifle, fired it in Elliott's general
direction, and he ran off. Police arrested him not long after the
incident in his van on Forest Grove's Fir Road. Police tell KATU that
Elliott did not break in, as other media has reported. Police said the
house was unlocked and the suspect let himself in. A burglary charge
still applies, since he was not supposed to be there. Police said this
is important to note so people in Forest Grove "aren't thinking some
crazy guy is breaking into houses and trying to rape women." Police
also told KATU that Elliot knew the victim's friends, and had gone out
with them earlier that night. (All's well that ends well but, despite
the believe in places and times where on can leave doors unlocked,
it's not a safe practice.)

Oops, Wrong House, Texas Version: It took one shot for an East Texas
senior to put an end to a would-be robber's crime spree. The story
began around 2am Monday morning at Southside Bank in Hawkins. The
branch is located inside Brookshire's, right off Highway 14. That is
where police say 19-year-old David McWhorter was spotted, first. We
spoke to the homeowner whose one shot landed the alleged burglar in
the ER. "Just...put the gun up to the window, and he was standing
there and I pulled the trigger," said the 78-year-old homeowner. One
shot through the window was all it took. Our homeowner didn't mind an
on camera interview, but asked his name not be released. He suffers
from a hip injury and was sitting in his chair when the suspect broke
into his screened porch. He says it is not the first time he has been
broken into. Every window is now nailed shut and a baggie full of ammo
for his 4-10 single-shot shotgun is always nearby… (All's well that
ends well but maybe his neighbors will chip in to buy him something
better for home-defense than a single-shot .410 [sic] shotgun.)

Big Brother Reverses US Position on Arms Treaty: Reuters is reporting
that the Obama administration has reversed U.S. policy and said it
would back launching talks on a United Nations treaty to regulate arms
sales, a move that is pro-gun activists warn is one giant leap toward
side-stepping Congress and overturning the Second Amendment… Although
President Obama is clearly doing their bidding, gun control extremists
are still not happy, saying they are opposed to the proposed consensus
rules because decisions on the treaty be made by consensus "could
fatally weaken a final deal." …The main opponent of the treaty in the
past was the U.S. Bush administration, which said national controls
were better. The change in policy is opposed by the National Rifle
Association, as well as by conservative U.S. think tanks like the
Heritage Foundation, which is quoted as saying the treaty will not
restrict the access of "dictators and terrorists" to arms but would be
used to reduce the ability of democracies such as Israel to defend

Not an Encouraging Turn: Federal prosecutors said Wednesday they have
arrested a Massachusetts man in connection with terrorist plots that
included attacks on U.S. shopping malls and on two White House
officials. The suspect has been identified as Tarek Mehanna, 27, of
Sudbury, Mass. He has been charged in connection with plotting with
other terrorists from 2001 to May 2008 to carry out overseas and
domestic terrorist attacks, which included killing shoppers and first
responders at malls. However, none of the attacks was carried out
because the conspirators could not obtain automatic weapons [emphasis

arrest argues for more citizens remaining armed in more locations. On
the other, it's likely to provide fodder for those alleging to want to

RKBA Attorney Counsels Patience: In the 1920s and 1930s, Jehovah's
Witnesses were viewed by many with the same horror and loathing gun
owners receive today. So the 1920s and 1930s saw widespread state and
local legislation against Jehovah's Witnesses, and though the Bill of
Rights guarantees freedom of speech and religion, it took 30 to 40
years of careful litigation - patiently piling up precedents to
achieve the overthrow of those laws by the Supreme Court. The
relevance of the Witnesses' experience to gun owners is that it will
take at least that many years of patient, careful litigation to remove
the morass of senseless anti-gun laws at all levels of government.
Unfortunately, the gun movement is afflicted by multiple glory-seekers
and fanatics disguised as lawyers - but without any real background in
constitutional litigation - bringing lawsuits that are sure to lose
and create disastrous precedents to adversely influence the
development of Second Amendment law. The most ill-advised of all would

CCW Remains Issue in California County: Citizen gun owners who
attended a hearing before the Orange County Board of Supervisors
testified, stating their dissatisfaction with the Sheriff's policy and
the fact that she was not elected to office. Many suggested that
Sheriff Hutchens has her own agenda, is intending to impose the Los
Angeles County policies on the citizens of Orange County and the Board
of Supervisors should distance themselves from her policy. During the
testimony, Sheriff Hutchens stood her ground refuting the citizen's
interpretation of her new policy saying, "I do not see this as a
Second Amendment Issue. The policy does not impact the right to have a
gun at home or in a place of business." Bill Hunt, a former OC
Sheriff's Lieutenant, who is expected to challenge Sheriff Hutchens in
the 2010 election was critical of Sheriffs and other Police Chiefs who
do not share the fundamental beliefs in values held in the

law, was appointed to fill the vacancy created when Mike Carona

Florida School District Bans Parking-Lot Storage: School employees,
students and visitors to schools will now need to make sure they leave
their concealed weapons at home, even if they have a permit. The
Georgetown County School District voted Tuesday to ban all concealed
weapons from all district property, including parking lots. The move
was in response to a plea from the Georgetown Police Department. A
state law enacted in June made an exception to the state's ban on
weapons on school property. The law allows those with permits to have
a concealed weapon on school grounds if it is in a parked car in a
locked compartment or if the individual is inside the vehicle… The law
passed by the General Assembly in June was designed to protect people
who have permits and keep guns in their cars when dropping their
children off at school, and teachers who keep their guns in their cars
for protection during their commute, said Sen. Shane Martin,
R-Spartanburg, one of the sponsors of the legislation… As for a local
policy counteracting state law, Dozier said there has been legal
precedence [sic] when an employer is able to ban concealed weapons on
their property. Employees who have concealed weapons permits and
weapons can park off school grounds, Dozier pointed out… (As I recall,

Dial 911 and Die?: Jorge Guzman locked himself in his bedroom, called
911, and waited for help while a home invader prowled around in his
home. Armed with his handgun, the emergency operator told him
repeatedly that help was on the way. As the minutes dragged on like
hours to a frightened Guzman, he was told to put down his gun because
the next person he saw would be a deputy. He almost complied, which
may have drastically changed the outcome… The dispatcher is not on
scene and doesn't know anybody's location. This places additional
stress on both the homeowner and deputies: The homeowner didn't want
to shoot a cop, and yet was considered an armed suspect until deputies
made a positive identification and secured the crime scene.
As a rightful defender, train smart and pay attention to the
situation. You must also remain in control. Had Guzman placed all his
trust in the dispatcher's words and put his gun down, he may have
become a statistic… (As with officers, the quality of dispatchers can
vary from incompetence and indifference to highly professional. If you
fail to plan, plan to fail. My CWP students are instructed on how to
interact with 911 operators and dispatchers. Use of a safe room is key
to home defense. Avoid wandering out of it, particularly once officers
arrive. Make sure that the dispatcher transmits your description and
those of other people who belong in the home to the officers, to
reduce the risk of mistaken-identity shootings, such as we recently

Ohio Cases Demonstrate Need for Campus Carry: Another wave of armed
robberies put Columbus college students at risk yet again due to the
archaic ban on legal concealed carry on campus. As a result, students
are easy pickings for criminals looking for a sure thing. In this
case, one student from Capitol University in Bexley was robbed and two
different students at Ohio State were targeted. One student was
kidnapped from the OSU campus at gunpoint and taken to an ATM to get
cash for his attackers. Luckily, none of the students were harmed. An
employee at a UniPrint store on the OSU campus, however, wasn't so
fortunate. Two armed suspects, both described as black males wearing
ski masks, forcefully entered the store before it had opened
(bypassing the "no-guns" signs prominently displayed on the front
doors) and pistol-whipped the employee…

Oops, Wrong House, Oregon Version: Police have arrested a man after a
woman was sexually assaulted in her own home in Forest Grove, just
west of the Portland suburb of Hillsboro…  KATU's investigation has
uncovered that Elliott is a 53-year-old transient. The woman was 23
years old, and was asleep in her home at the time. We're told that the
woman grabbed a 22-caliber rifle, fired it in Elliott's general
direction, and he ran off. Police arrested him not long after the
incident in his van on Forest Grove's Fir Road. Police tell KATU that
Elliott did not break in, as other media has reported. Police said the
house was unlocked and the suspect let himself in. A burglary charge
still applies, since he was not supposed to be there. Police said this
is important to note so people in Forest Grove "aren't thinking some
crazy guy is breaking into houses and trying to rape women." Police
also told KATU that Elliot knew the victim's friends, and had gone out
with them earlier that night. (All's well that ends well but, despite
the believe in places and times where on can leave doors unlocked,
it's not a safe practice.)

Oops, Wrong House, Texas Version: It took one shot for an East Texas
senior to put an end to a would-be robber's crime spree. The story
began around 2am Monday morning at Southside Bank in Hawkins. The
branch is located inside Brookshire's, right off Highway 14. That is
where police say 19-year-old David McWhorter was spotted, first. We
spoke to the homeowner whose one shot landed the alleged burglar in
the ER. "Just...put the gun up to the window, and he was standing
there and I pulled the trigger," said the 78-year-old homeowner. One
shot through the window was all it took. Our homeowner didn't mind an
on camera interview, but asked his name not be released. He suffers
from a hip injury and was sitting in his chair when the suspect broke
into his screened porch. He says it is not the first time he has been
broken into. Every window is now nailed shut and a baggie full of ammo
for his 4-10 single-shot shotgun is always nearby… (All's well that
ends well but maybe his neighbors will chip in to buy him something
better for home-defense than a single-shot .410 [sic] shotgun.)

He's Still Alive so It's Not a Darwin Award: A Tulare man shot himself
without the use of a gun, police said. Police said the 18-year-old man
was holding a bullet with pliers when he smashed it with a hammer,
setting it off and shooting himself in the foot. The injured man was
taken to Community Regional Medical Center in Fresno, where he was
treated and released. Tulare police Sgt. Darron Altermatt said the man
won't face criminal charges stemming from the incident, reported at
11:10 p.m. Friday. The incident occurred at a home in the 400 block of
North B Street. It was not known exactly why the man hammered the
bullet. (Generally bullets that are fired in this manner don't attain
much velocity as the cartridge is not supported and there is no barrel
in which the burning powder can continue to accelerate the bullet. I
guess we owe this "scientist" a vote of thanks for proving that such a
bullet can penetrate flesh. I have seen a .22 round that cooked off in
a trash fire fail to penetrate a friend's jeans but he was probably a
few feet farther from the cartridge when it cooked off.)

Tangentially Related: …Why was there less crime years ago? Because
people were vigilant.  They took action when persons came into their
area who did not belong, and they knew who lived in their neighborhood
and who did not.  Today most people do not even know who their
neighbor is, let alone if something is out of place.  Toward the end
of my career, I have taken reports where heinous crimes had been
committed next door.  The neighbor heard it and did not even bother to
call police.  They said it was none of their business.  Or the
neighbor was not home.  Even if a neighbor calls the police,  it would
have made little difference in the life of the victim.  However in
each case had the victim been prepared, or a neighbor been prepared
and cared enough to intervene as soon as the trouble started, things
would have been different.  Something to remember when you think the
police protect you or that your neighbor will call the police if they
hear something or intervene on your behalf.

An Army investigation found that soldiers should not have been sent to
man traffic stops in a small Alabama town after 11 people were killed
in March during a shooting spree. An Army report released to The
Associated Press on Monday in response to a Freedom of Information Act
request said the decision to dispatch military police to Samson from
nearby Fort Rucker broke the law. But an Army spokesman said no
charges have been filed following the Aug. 10 report… The report from
the Department of Army Inspector General found the use of military
personnel in Samson violated the Posse Comitatus Act, which prohibits
federal troops from performing law enforcement actions. The names of
those involved were redacted from the report…

A Slippery Slope: Nationalization of concealed carry laws would make
things in this country simpler and much safer. Currently, under
federal legal precedent it is legal for states to allow concealed
carry with a permit, or even with no permit at all, says Laurie
Ekstrand, established author. By nationalizing concealed carry laws,
all states would have to have the same regulations governing concealed
carry, making things much simpler than in the status quo. Because this
would require permits to be issued and background checks to be
conducted before concealed carry would be allowed, things would be
much safer. This would also impose strict regulations on who can carry
a concealed weapon and where they can carry it, thus making the
chances of accident or misuse much slimmer… (At least this advocate
admits that bringing in the feds would entail "strict regulations."
She neglects to deal with how such regulations would not eventually
include psychiatric exams, the same "qualifications required for
LEO's, certification of need, etc. I hope that by "federal legal
precedent" she means that the federal nature of our republic mostly
allows each state to set its own standards.)

The Beat Goes On: The demand for concealed handgun licenses is on the
upswing, and a local police department is meeting the need to teach
people how to exercise their right responsibly. The trend is
widespread across Texas, and most people are attributing the increase
to the presidential election of Barack Obama because people started
fearing their right to bear arms may be limited under the new
administration. Beginning in December 2008, the Texas Department of
Public Safety started receiving an unprecedented number of
applications of concealed handgun permits, said Tom Vinger, assistant
chief of DPS media relations. During the first six months of 2009, DPS
received an average of 12,700 applications per month, which is 46
percent more than the average for the first six months of 2008, which
was 8,700. Montgomery County is no different than the rest of the
state. The state granted 1,892 CHLs to county residents between Sept.
1, 2007, and Aug. 31, 2008. For the same period from 2008 to 2009,
with two months to go, 2,464 have been granted to residents, which is
a 30 percent increase…

More people are learning how to shoot on target. According to Fayette
County's New River Concealed Carry owner Kevin Willis, who's also a
Fayette County [WV] Sheriff's deputy, requests for concealed weapons
permit training courses - which are required by the state prior to
obtaining a permit - are on the upswing. The 11-year police veteran
says this is a good thing. "Any person that wants to use a handgun for
self-defense should know how to own and operate one safely," Willis
commented. Willis says an increase in crime rates and a fear of
stricter gun control under the Obama administration are the plausible
motivations behind the public's newfound interest in guns… Once the
course is completed, students can apply for a concealed weapons permit
at their local sheriff's department for a fee of $75. The permit
remains active for five years…

More than 2,000 people walked through the UAF Patty Center doors this
weekend for the annual Tanana Valley Sportsmen's Association Fall Gun
Show. Buyers, sellers and spectators alike this weekend attributed the
nationwide surge in gun and ammo sales to worries that the Obama
administration and a Democratic-controlled Congress will make a move
to restrict gun ownership. Though this weekend wasn't the first gun
show since the presidential election, the record turnout was also
boosted by the release of the Permanent Fund Dividend. "I think it's
common to see sales go up a little when the PFD comes out, but I think
there is a lot of fear out there that is fueling people to buy guns
and ammo," said William Galligan, a senior at UAF and member of the
Alaska Nanooks rifle team. "Smith and Wesson sales have gone through
the roof since the election, not to mention the price and availability
of ammo. You almost can't find it anywhere and a lot of people have
resorted to trying to make their own." According to his teammate, Cody
Rutter, finding ammo in town has become a challenge, even at major

Fifth Circuit Upholds USPS Parking-Lot Ban: On October 14, 2009 the
United States Circuit Court of Appeals for the Fifth Circuit upheld
the conviction of a postal employee for possessing a gun in his
vehicle while parked on a non-public United States Postal Service
(USPS) parking lot in violation of a federal regulation at 39 CFR
232.1(l). The court's opinion in United States v. Doroson can be found
here. Mr. Doroson had appealed the conviction on the ground that the
USPS gun ban violated the Second Amendment. The Fifth Circuit panel
disagreed, writing that, "the Postal Service used the parking lot for
loading mail and staging its mail trucks. Given this usage of the
parking lot by the Postal Service as a place of regular government
business, it falls under the 'sensitive places' exception recognized
by Heller." The Court did not indicate whether the Second Amendment
would protect gun owners from prosecution if they possess a gun in the
public areas of USPS property. Even though USPS parking lots are often
indistinguishable from other public parking lots, and are not posted
to warn the public of the gun ban, USPS spokesperson Joanne Vito told
the Examiner.com that 39 CFR 232.1(l) … (As to mailing firearms, FFL's
can actually mail handguns to each other but the process requires a
written declaration.)

A Proposal for Wisconsin: Open carry has always been the law of the
land in Wisconsin, however some people are now having regrets they
supported the Governors two veto's of concealed carry legislation.
There is new talk from the Milwaukee District Attorney and Milwaukee
Police Chief about passing a concealed carry law in exchange for our
liberty. Well, no thank you… Since a carry law is not really about
guns (or "gun rights") but a citizen's right to possess the proper
tool needed to maintain their constant state of peace, I am providing
a basic framework below about what a good carry law for Wisconsin
should include. Anyone may disagree but if you do there are some rules
you must follow. I expect you to provide independently verifiable
evidence why I am wrong (your opinions do not count) and then offer an
alternative idea that can be verified will work better. If you want
the legislature to write a good carry law, it is more likely to happen
if you tell them exactly what you want… (When licensed CCW was being
debated in the Arizona legislature, there was one group of gun owners
who opposed it, for fear that a drop in lawful, unlicensed open carry
would eventually "allow" the legislature to restrict or ban that
practice.)

Here's a Suggestion: In these difficult economic times, Gov. Paterson
has called for $3 billion in budget cuts. The New York State Rifle &
Pistol Association has a suggestion for saving several million
taxpayer dollars each year: abolish the Combined Ballistic
Identification System (COBIS). The COBIS program was introduced by
Gov. Pataki in 2000. Its stated purpose is to collect identifying data
from the shell casings of all new handguns sold in the state. This
information is then entered into a database for use by law enforcement
to aid in identifying and prosecuting criminals. Since its inception,
over a quarter of a million shell cases have been collected and
entered into the database at an estimated cost of $32 million and not
a single arrest or conviction has resulted. In fact, COBIS has proven
to be such a boondoggle that no other state is even considering
implementing their own version of it. If Gov. Paterson is serious
about saving money, then COBIS ought to be at the top of the list of
programs to be cut. (I believe that Maryland has a similar program, if
it's still in operation – a few years back the state police ask to
scrap it so that they could use the funds for more productive
projects.)

Do Not Pass Go, Do Not Collect $200: A 39-year-old man, who reportedly
shot and killed another man in self-defense Sunday night in Anderson,
has been turned over to U.S. marshals in anticipation of a federal
weapon charge. McDonald County [MO]  Sheriff Robert Evenson said
Matthew D. Robertson, 32, died of a single shotgun blast during an
altercation with Michael J. Smith at the Wallain Court apartment
complex in Anderson, where both men lived in separate units.
Authorities received a call at 8:30 p.m. reporting the shooting at the
apartments and found Robertson dead, the sheriff said. Evenson said
deputies determined that Robertson was in the act of breaking in the
door to Smith's home when Smith shot him in the chest with a
.410-gauge shotgun. "It appears that he is not going to be charged
with any homicide-related charge," the sheriff said... But, because of
a prior felony conviction, the U.S. attorney's office in Springfield
plans to charge Smith with being a felon in possession of a firearm,
Evenson said. Smith was transferred to the custody of the U.S.
Marshals Service. Specifics of the prior felony conviction were not

But the Deaths Were Not Firearm-Related: Two people died in Okanogan
County [WA] during the inaugural weekend of the general firearms deer
hunting season. Okanogan County Sheriff Frank Rogers said deputies and
dispatchers had a busy opening day of deer season Oct. 17. Among the
calls were the two deaths, lost and injured hunters, and trespassing
and shooting complaints. A boy called dispatch around 3:35 p.m. to
report that his father had fallen and struck his head on some rocks,
Rogers said… Deputies and Aero Methow Rescue personnel responded and
found the man, who was deceased, Rogers said… Earlier in the day, at
6:30 a.m., dispatch was notified of a possible heart attack victim on
Baldy Pass near Conconully. The man, 42, was transported off the
mountain in a private vehicle, which was met by emergency personnel.
The man was taken to Mid-Valley Hospital, Omak, and died there, Rogers
said… (Those who hunt are often advised to take a couple of months
prior to the season and ensure that they are in adequate physical
condition to do so.)

Another Look at M4 Failures: …There was one thing mentioned in the
news stories that has some relevance, and that's rifles jamming (not
because of heat problems). This goes back to the decades old argument
about replacing the recoil system in American assault rifles. This
came to a head (again) two years ago, when the army ran more tests on
its M-4 rifle, involving dust and reliability. Four weapons were
tested. The M4, the XM8, SCAR (Special Operations Forces Combat
Assault Rifle) and the H&K 416 (an M4 with the more dust resistant
components of the XM8 installed). The testing consisted of exposing
the weapons to 25 hours of heavy dust conditions over two months.
During that testing period, 6,000 rounds were fired from each of ten
weapons of each type. The weapons with the fewest failures (usually
jams) were rated highest. Thus the XM8 finished first, SCAR second,
416 third and M4 last. In response, the army said it was satisfied
with the M4s performance, but was considering equipping it with a
heavier barrel (to lessen overheating) and more effective magazines
(27 percent of the M4s 882 jams were magazine related.) The army noted
that the M4 fired over 98 percent of its rounds without problems. The
army had been forced by Congress to conduct the tests. Congress was
responding to complaints by the troops…(The die has already been cast
with SCAR for SOCOM, which is proceeding with SCAR Light [.223] and
SCAR Heavy [.308].)

bullets. The private-equity firm is in advanced preparations for an
initial public offering of Freedom Group Inc., said people familiar

business. Over a three-year span, Cerberus - while under the spotlight

When Guns Are Outlawed: Punishment or "respect" shootings are a
growing trend among young gang members in London, say police. Officers
from the [London] Metropolitan Police are looking into 72 reported
cases of people being shot in the legs this year, more than double the
33 incidents in 2008. The cause, according to senior officers, could
be an increase in punishment shootings, or attacks to garner
"respect", where shooters intend to wound their victims rather than
kill them. Commander Martin Hewitt of the Met said: "We are noticing a
propensity amongst a small element of people to use extreme levels of
violence for seemingly very little reason. "Often this is done to, in
some way, protect their reputation in the eyes of their peers." He
added: "When Trident first started, the gun crime that was taking
place was the enforcement offshoot of organised crime. "Where it is
different now is that it is less to do with organised crime but more
to do with respect issues and disagreements. It is more chaotic, more
spontaneous. It is a matter of reputation and issues around peer

Tangentially Related: Howard Unruh, who carried out one of America's
most infamous mass shootings, killing 13 people, three of them
children, in a 20-minute, seemingly emotionless stroll through his
neighborhood in Camden, N.J., in September 1949, died Monday at a
nursing home in Trenton after 60 years' confinement. He was 88… Mr.
Unruh was found to have paranoid schizophrenia and never stood trial.
He was confined to the high-security Vroom Building for the criminally
insane at Trenton Psychiatric Hospital until 1993, when he was
transferred across the grounds to less restrictive wards in a
geriatric unit… Mr. Unruh fled to his apartment. Some 50 police
officers converged there and blazed away with machine guns, shotguns
and pistols… After the police fired tear gas, Mr. Unruh came outside,
his hands held high, his bow tie still in place…

Gratia-Hupp Book Released: Women who make a difference: The title of
this article is also the title of a new book coming out in November.
It was written by Dr. Suzanna Gratis-Hupp who testified before
congress telling the graphic story of how she witnessed 23 people
gunned down in a restaurant named "Luby's" in Killeen, Texas – those
victims included her parents who has just celebrated their 47th
wedding anniversary. It was a bright shiny day outside on that fatal
day on October 16, 1991. But the memory of that day will forever bring
darkness to the hearts of those who lost loved ones on that day.
Dr. Gratis-Hupp is a chiropractor by profession; but has also served
in the Texas legislature. Her new book, "From Luby's to the
Legislature: One woman's fight against gun control," is the result of
seeing her parents and others gunned down by a mad man, whom she does
not hold anger against; but is angry against the congress that caused
her not to have her gun with her on that fatal day. You can see and
hear her story on the video below. As in many cases, when a person
suffers a tragic event in their lives; it spurs them on to make a
difference and to make changes… (Her maiden name is actually
